From somewhere in this small planet and while new about what was going on after September 17th, my perception about the period of time that I will have to spend out of the country kept changing rapidly. If in the beginning I said good bye thinking that at least I would be a year away, since such was the lapse that I considered necessary to prepare a hypothetic return where a sure trial would be waiting for me, soon I realised that this was not so clear.

While the impact of S-17th made me think that there would be many possibilities of such a great support that it would be complicated to make me end up in jail, the total explosion of the crisis by mid September became a motivation to dedicate all my energies in order to take advantage of the moment. The thought that took shape was that maybe the reason for coming back was no longer the hypothetical trial which was not sure to be carried on, but the desire to participate and profit from the opportunity for social change that the crisis offered and which was in the origin of my expropriation act.

After such reflexion and the subsequent change of plans, on the October 17th release I was already saying:

“On my account, since there were no police reports and in order to be active for the social mobilisations during this historic juncture in which we are now involved, I will soon leave my clandestine position and go back to political activity.”

After the said release, the ‘Mossos d’Esquadra’ (the Catalonian police) informed that “a total of 18 financial institutions have presented police reports because of delays in payment of the credits granted to the activist Enric Duran’ [...]

However, if I said that I would soon be back to public activity, is because I was going to do so with or without police reports. In fact, events made me change my plans after a few weeks out of the country. Nevertheless, I should not rush because if I arrived too soon we would not have enough time to prepare. Therefore, soon it came to my head the date of March 17, six months after September 17, as the most adequate moment for the public return to Catalan territories in order to set up a new D-day, this: M-17.

Months afterwards, at the present date, the Instruction Court N° 29 in Barcelona has only received four penal reports against me, which were placed by the following organizations: La Caixa, Bancaja, Caixa Sabadell y Bankpime. The performance of the judge regarding this summary has been the provisional filing of the case. The cause of this file has not gone beyond. In order to reopen the case it would be necessary that any of the organizations that accuse me, or the public prosecutor demanded so.

We do not have information about the rest of the 18 police reports the Mossos d’Esquadra declared to the press on October 17. Anyway, according to my lawyer, it is probable that if more reports arrive, they would be addressed to the same judge and filed under the same conditions.

Why did I return?
Now that I am back, I have doubts if they will reopen or not the case. It does not matter. It should be clear that I have not come back to confront a trial or to elude it. That they want or do not want to judge me is not important. What is important is that our future is at stake. If I am here is because I think that, it is in the environment that I know where I can be more useful for the collective action. It is here that I have more and better connections.

It should be clear, no matter how spectacular my ‘action’ could be, it is on the individual aspect the it became useful for the change, but as part of a social movement more and more massive. Even though the official media stays only with the particular anecdotic side and calls me “Robin of the banks” (it is a simplification of reality, very often made on purpose) it is not this banks expropriation what has made me respected but the many years of activism and serious work shared with so many people, as those who have made this publication arrive to your hands, which is important by all its content and not by what is said on page 9.

Regrets? None. I consider that the means utilised have been completely coherent with the objectives to be achieved, which are not others than to open the way to abolish the present system and start the practice of viable alternatives. I think that it has been demonstrated that I have acted under the sentiment of a situation of necessity: The necessity of society and the future generations. Also, I have acted moved by the observance of a duty, the duty to make, as a social activist and individual, whatever is in my hand in order to sensibiliser about the most critic aspects of our present time. I reiterate my compromise with the disobedience to the banks and the rest of the dominant powers in our society that moved by whoever knows which ambitions or what lack of self esteem, keep insisting in taking all of us through the roads of ecologic catastrophe, as well as of vital precariousness, loneliness, and competence in our social relations.

It is the moment to raise up to accomplish with our duty as people and proclaim out loud that disobedience to the bank system, the governments, and every one who pretends to force us to continue with this economic system, destructor of lives and futures, it is not an utopia but a bright sample of common sense and good will. No matter what the judges, politicians, and bankers might say, Nature and most part of Humanity are on our side. If we really want to be free, we must participate in the change. We have to be able to overcome fear and be living and willing actors of our lives, and be ourselves the change that we want to see in the world. TOGETHER WE CAN!!!

Insolvency is a form of immunity to being fined.

Since not fulfilling the civil code is punished with economical fees, whoever organizes himself in order to avoid impound becomes a person immune to civil code, for example, to civil laws with municipal character, because if they fine him, he just cannot pay. It is an armoured someone that can go in the subway without paying, that can hang or paste posters without fear, that can tell its name aloud to summon for a protest march. For those of us who want to change this system, actions from organized debtors can be a powerful tool for the change.

Ten days in prison for being disobedient to speculation and fines

It is not only a civil tool. In the terms of criminal law, it is pretended more and more to suppress social movements with economical punishment since they are forms to sentence light offenses. In this case, active insolvency is an adequate answer.

With insolvency they can only punish us if they take our liberty, but if we are a strong movement it would not turn out so easy for them. In this line, an activist in defence of Collserola who has declared himself unsubmissive to a fine imposed as result of an action against the real estate project ‘Plan Caufec’ in Esplugues de Llobregat, will have to spend 10 days in jail.
